1. Acceptance of Terms

By accessing or using the mimūn website and purchasing mimūn products, you agree to be bound by these Terms of Service. If you do not agree to these terms in their entirety, you must not use this website or place any order. These terms constitute a legally binding agreement between you and mimūn fragrance, a company incorporated in the United States.

2. Products and Descriptions

mimūn makes reasonable efforts to describe its products accurately. However, we do not warrant that product descriptions, images, or other content are complete, accurate, reliable, or error-free. Product colours and appearances may vary due to photography conditions and individual screen settings. All products are sold as cosmetic items only and are not intended to diagnose, treat, cure, or prevent any condition.

mimūn products are formulated and tested to the safety standards of EU Cosmetics Regulation (EC) No 1223/2009, including independent safety assessment by a qualified cosmetic safety assessor. This voluntary compliance with EU standards does not create any additional legal obligations beyond those required under applicable US law.

3. Product Use and Customer Responsibility

By purchasing a mimūn product, you accept full responsibility for its use. You acknowledge that you have read the product description, ingredient list, and any applicable warnings. You agree to perform a patch test on a small area of skin at least 24 hours before full application. mimūn strongly recommends this precaution for all customers, particularly those with known sensitivities or allergies.

Performing a patch test does not guarantee the absence of a reaction. Individual skin responses vary and cannot be predicted with certainty.

4. Limitation of Liability

To the fullest extent permitted by applicable law, mimūn's total liability to you for any claim arising out of or in connection with these terms, your use of the website, or your purchase of products shall not exceed the amount you paid for the specific product giving rise to the claim. mimūn shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, personal injury, or property damage.

5. No Warranty

Products are provided on an "as is" and "as available" basis. To the extent permitted by law, mimūn disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. This does not affect any statutory rights you may have under applicable consumer protection law.

6. Indemnification

You agree to indemnify, defend, and hold harmless mimūn, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your misuse of the website or products, your violation of these terms, or your violation of any third-party rights.

7. Intellectual Property

All content on this website — including but not limited to text, photography, product names, the mimūn wordmark, fragrance names, and design elements — is the exclusive intellectual property of mimūn fragrance. No content may be reproduced, distributed, modified, or used for commercial purposes without prior written consent from mimūn.

8. Force Majeure

mimūn shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, pandemics, government restrictions, carrier disruptions, natural disasters, or civil unrest.

9. Governing Law and Jurisdiction

These terms are governed by and construed in accordance with the laws of the United States and the state in which mimūn is incorporated, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of that state. Nothing in this clause limits any rights you may have under applicable consumer protection laws in your country of residence.

10. Severability

If any provision of these terms is found to be invalid, unlawful, or unenforceable, that provision shall be deemed modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions shall continue in full force and effect.

11. Changes to These Terms

mimūn reserves the right to update these terms at any time. Changes will be posted on this page with an updated effective date. Continued use of the website following any changes constitutes acceptance of the revised terms.
